Tournamic is a web-based platform for tracking sports matches, managing tournaments, and analyzing performance data. The service includes:

• Match creation and result tracking
• Performance analytics and statistics
• Tournament organization and management
• User profiles and social features
• Data export and sharing capabilities

3. Eligibility and User Accounts

3.1 Eligibility

You must be at least 16 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement.

9. Limitation of Liability

In no event shall Tournamic be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

9.3 Maximum Liability

Our total liability to you for all damages, losses, and causes of action shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless Tournamic and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the Service.

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in the Service.

11.2 Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11.3 Effect of Termination

Upon termination, your right to use the Service will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive termination.

12. Governing Law and Jurisdiction

Anwendbares Recht: German Law

These Terms of Service are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods and conflict of law provisions.

Jurisdiction: For all disputes, the courts at the operator's place of business have jurisdiction.

EU Consumer Rights: EU consumers may additionally file claims before the courts of their country of residence.
